Records for a shared Spanish lottery ticket
This guide covers records relating to a shared Spanish lottery décimo: what the templates show, how to read the examples, and the limits of a copy or message. The information on prize collection and taxes concerns Spain.
The Maxiloto share generator formats the PDF document. This article concerns records and their limits; the generator and PDF guide explains how the tool works. A generated PDF does not replace the ticket or legally validate an agreement.
Information reviewed on 4 October 2026. The templates are illustrative. They do not, by themselves, guarantee the validity of an agreement or the outcome of a claim. Older illustrations are identified as archive examples.
Illustrative agreement template
The template records the draw, ticket, custodian and allocation. Each person's amount and share must match the actual agreement; a template does not replace that check or the original ticket.
AGREEMENT TO SHARE A LOTTERY TICKET
Draw: [e.g., Special Christmas Lottery Draw]
Draw Date: [Full draw date]
Ticket Number: [Full 5-digit number]
Series / Fraction: [Data identifying the ticket]
Custodian (Person responsible for the ticket): [Full name and ID of the person holding the ticket]
LIST OF PARTICIPANTS AND CONTRIBUTION:
- [Participant 1 Full Name and ID]: Plays [Amount in €]
- [Participant 2 Full Name and ID]: Plays [Amount in €]
- [Add as many lines as necessary]
The archive image below reproduces a Spanish contract template for equal shares. That condition does not describe an allocation based on unequal contributions. It is retained as an illustration, not as a document validated for every situation.
Historical example: a €5 share
This fictional example concerns Christmas 2025, the date shown in the illustration. It does not represent a current ticket or draw.
The Case: The "Office-Luck" Group
In the example, Laura Fernández García is the custodian of number 85432, and Javier Pérez López's contribution is €5. The amount matches the image.
The example document records the same amount. The names and identification details are fictional:
AGREEMENT TO SHARE A LOTTERY TICKET
Draw: Special Christmas Lottery Draw
Draw Date: December 22, 2025
Ticket Number: 85432
Custodian (Person responsible for the ticket): Laura Fernández García (ID 12345678-A)
LIST OF PARTICIPANTS AND CONTRIBUTION:
- Javier Pérez López (ID 87654321-B): Plays €5.00
- (The rest of the colleagues would go here...)
The illustration shows a €5 share dated 2025. It is an archive design and does not show the current output of Maxiloto's generator.
Analyzing the Keys of the Visual Example
These are the details visible in the example. Consistent information matters more than the graphic design:
- Number and amount: the image shows 85432 and €5.
- Example date: 22 December 2025.
- Custodian: it names Laura Fernández García, a fictional name in this illustration.
- Limits: the image does not contain a full participant list and does not replace the original ticket.
The 2025 date belongs solely to this archive example. In a real document, the number, draw, date, amount and responsible persons must match the corresponding records.
Records and limits of each format
A message, copy or receipt can record an agreement, but no format automatically makes its contents indisputable evidence. Identity, contents and authenticity may matter in a dispute.
1. Agreements retained in WhatsApp or email
For an agreement retained in WhatsApp or email, the details should be consistent and show what each person accepted. A photograph on its own may not explain the allocation:
- Create a specific group: Gather ALL participants in a new WhatsApp group with a clear name (e.g., "[Draw name and date] - [Group]").
- Send a quality photo of the ticket: Take a clear and legible photo of the complete ticket, front and back! This shows all validation data.
- Agreement contents: Use the template we've seen to write a message with all the details: draw, date, number, who the custodian is, and the list of participants with the amount each one plays.
- Confirmation of the contents: An express reply helps record what was accepted. It is not automatic legal validation of the entire agreement.
2. The Traditional Method (Signed Paper Copy)
The next image shows an older blank receipt template with a counterfoil. It is not a photocopy of an official ticket or an already signed document.
The receipt's details should match the agreement and identify the people and their contributions. In this guide's example:
- Participant's full name: (e.g., "Javier Pérez López")
- Amount played: (e.g., "Plays €5 of this ticket")
- Your name and ID as custodian: (e.g., "Custodian: Laura Fernández García, ID...")
- Your signature.
A signed copy may provide a record of the agreement. Its evidential value is not an absolute guarantee: authenticity and contents may be disputed.
3. The Formal Method (Associations, Groups, and Companies)
Using a template does not resolve the requirements for an association, donation or surcharge. Before organising such an activity, check the applicable requirements with SELAE and, where relevant, the competent authority or a professional. This template is not an authorisation.
How to Claim a Shared Prize and Manage Taxes
If the prize is LESS than €2,000
The custodian can collect it at any lottery administration and distribute it among the participants.
If the prize is €2,000 OR MORE
Prizes of €2,000 or more per décimo or receipt are paid by financial institutions authorized by SELAE in Spain. All holders must be identified. Large groups may appoint a representative through a notarized power of attorney. Check the required documents with the bank.
Taxes on a Shared Prize: How It Works
In Spain, Christmas Lottery prizes have a €40,000 exemption per décimo. The 20% tax applies only to the excess. For a shared décimo, both the exemption and the taxable amount are allocated according to each holder’s percentage.
The payer withholds the tax when paying the prize. Beneficiaries and their percentages must be identified, and evidence of the distribution retained. The exemption is not €40,000 for each participant. See the Spanish Tax Agency’s information on shared prizes.
Practical example with "El Gordo" Christmas prize:
- Prize per ticket: €400,000
- Tax-exempt portion: - €40,000
- Taxable base (amount subject to tax): = €360,000
- Taxes to pay (20% of €360,000): = €72,000
- Net prize to be distributed: €400,000 - €72,000 = €328,000
If all ten people hold equal shares (10% each), each receives €32,800 after Spanish withholding. Different percentages produce a different allocation. These rules concern Spain; tax residence and the type of beneficiary may entail other obligations. Consult a tax adviser about your circumstances.
Frequently Asked Questions (FAQ) about Lottery Shares
What evidential value can a WhatsApp agreement have?
Messages may be submitted as evidence, but their admission and assessment depend on the circumstances and authenticity. An 'OK' does not by itself guarantee the validity of the whole agreement. See the Spanish Civil Procedure Act, Articles 299 and 326.
What happens if the person holding the ticket loses or damages it?
Damage does not automatically mean a prize is lost: SELAE provides for damaged tickets to be submitted for authentication. For loss or theft, promptly contact the authorities and check the applicable procedure. A photo or digital receipt does not by itself guarantee payment. See SELAE's information on payment, damage and theft, pages 21–22.
Which records distinguish an online purchase from an allocation?
The purchase receipt, custody terms and agreement between participants are different records. Forwarding an image does not by itself establish who participates or their respective shares. Check the service terms and retain the allocation records; this guide does not replace those terms.
Can a donation or surcharge be added to the share?
The template does not establish that a donation or surcharge is authorised. The requirements may depend on the activity and the organising entity. Check them before using the template for that purpose.
Custody and record-keeping tools
The allocation agreement and the ticket receipt serve different purposes. The identity of the original ticket's custodian, or the contracted custody terms, should be clear. No format completely removes the risk of mistakes or disputes.
